Facing criminal charges can feel overwhelming, especially when you don’t know what lies ahead. At Orris Law Corporation, we’re here to support you through every phase of your legal journey—with clarity, experience, and strategic advice tailored to your case.

Here's what to expect and how we can help at each stage.

An investigation means the police are gathering evidence to determine whether a crime has been committed and whether you may be involved. If they believe there’s enough evidence to support laying charges, they submit a Report to Crown Counsel (“RTCC”) recommending charges. The Crown (i.e. the prosecutor) will then decide whether to proceed on approving those charges based on whether there’s a substantial likelihood of conviction and whether prosecution is in the public interest. Being under investigation is often the most critical point in your legal journey.

What you say—or don’t say—can significantly impact what comes next. That’s why it’s important to speak with a criminal defence lawyer first. It’s to your advantage to retain counsel at this stage, so you can understand your rights, avoid missteps, and be advised on how to navigate the investigative process strategically.

Detention or arrest means your freedom is restricted. This can happen with or without charges being formally laid. Either way, it triggers your constitutional right to speak to a lawyer. The police must inform you of this right and provide a reasonable opportunity to exercise it.

Dealing with the police is a stressful and overwhelming experience. Retaining a lawyer to help you navigate a detention or arrest is essential to protecting your interests.

A detention is when the police stop you or hold you for questioning about an allegation they are investigating.

An arrest is often made when police have decided to charge you with an offence—but you can be arrested even before you are charged. Once you're arrested and charged, the government has formally begun prosecuting the case against you.

After an arrest, the question of bail—or judicial interim release—is often the first major hurdle. Being denied bail can mean waiting weeks or months in custody before your trial. A strong bail plan can make the difference between being at home or behind bars.

We also assist family or friends acting as sureties and provide guidance throughout the bail process.

After your initial court appearance, the Crown is required to provide the evidence they intend to rely on to prove the allegations against you. This is known as “disclosure” or “particulars” and may include police reports, witness statements, surveillance footage, and other materials. Disclosure is a critical part of the process—it forms the foundation of any defence strategy.

Navigating disclosure can be complex. A criminal defence lawyer will ensure you obtain all relevant materials, review them carefully with you, and identify legal and factual issues to begin building a strong defence.

We review disclosure in detail to identify legal issues, inconsistencies, or gaps in the Crown’s case. We then walk you through it, explain your options, and begin building a defence tailored to your specific circumstances.

Once disclosure has been provided and reviewed, you'll be asked to enter a “plea”—telling the court whether you are “guilty” or “not guilty” of the charges. A guilty plea results in a conviction and a criminal record, as well as other potential consequences. A not guilty plea moves the case forward to trial.

There are specific legal requirements that must be met before the court can accept a guilty plea. It’s essential to fully understand what each option means—not just legally, but personally and practically. A defence lawyer will help you navigate those requirements and give you the guidance you need to make a decision that aligns with your best interests.

We explain the implications of each option clearly and help you make an informed decision that protects your future. If you choose to resolve the matter early, we negotiate with the Crown to pursue the most favourable outcome available.

If you plead “not guilty”, the next step is to set trial dates. In more serious or complex cases, you may have the right to choose how your trial proceeds. Depending on the charges, you may be able to elect trial in Provincial Court before a judge, or in Supreme Court—either before a judge alone or a judge and jury. Your lawyer will help you understand the differences and advantages of each option.

At trial, the Crown has the burden to prove the charges against you beyond a reasonable doubt. They will present evidence and call witnesses to testify. Your lawyer will have the opportunity to cross-examine those witnesses and challenge the Crown's case. You may also choose to present evidence in your defence, although you're not required to do so. If you decide to testify or call witnesses, your lawyer will guide you through the process and help you prepare.

Once both sides have presented their evidence and arguments, the judge—or jury—will determine whether you are “guilty” or “not guilty”. If you are found guilty, the matter proceeds to sentencing.

If you're found “guilty” or choose to plead guilty, the next step is sentencing. This is where the court decides what consequences you will face—anything from a discharge or fine, to a conditional sentence, or jail time. Sentencing considers many factors: the nature of the offence, your personal background, any mitigating circumstances, and the broader public interest.

A fair and well-prepared sentencing hearing can significantly impact the consequences to you. It's not just about the law—it's about telling your story in a way the court understands.
